Brokers Being Threatened With Legal Action Over Websites

Real estate brokers in Texas are increasingly receiving threats of litigation regarding accessibility of their websites. The Americans with Disabilities Act and the Fair Housing Act prohibit discrimination against individuals with disabilities. If a broker’s website is not designed appropriately, individuals with disabilities may not be able to access the website and that lack of access could be considered discrimination under the ADA and the Fair Housing Act.

The National Association of REALTORS® and two Texas REALTORS® E&O Risk Management Partners have provided information for REALTORS® about these types of legal claims that are being made. Visit texasrealestate.com to read the letters and learn what you can do if you are threatened with litigation.
